Article 1 - Purpose
These Terms and Conditions govern sales made by BENOTSHOP, hereinafter referred to as the Seller, and the Buyer.
The seller reserves the right to modify these General Terms and Conditions of Sale at any time. Nevertheless, the version in force at the time a product is ordered will govern the fate of that product.
Article 2 - Prices
Product prices are quoted in euros unless otherwise stated and exclude processing and shipping costs.
Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of the seller. They shall be borne by the purchaser and are the purchaser's sole responsibility, both in terms of declarations and payment to the competent authorities and bodies in the purchaser's country.
At the buyer's request, an export sales note may be issued.
All orders, whatever their origin, are payable in euros.
The seller reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time the order is validated and subject to availability.
The products remain the property of the seller until full payment has been received.
Article 3 - Orders / Order validation

All orders received will be confirmed within 2 working days.
Any confirmation of an order implies the buyer's full acceptance of these general terms and conditions of sale, without exception or reservation.
The seller reserves the right not to register a payment and not to confirm an order for any reason whatsoever, particularly in the event of a supply problem or in the event of any difficulty concerning the order received.
All the data supplied and the recorded confirmation will constitute proof of the transaction.
The buyer declares that he is fully aware of this.
Confirmation of the order will constitute signature and acceptance of the operations carried out.
Article 4 - Payment
- Standard university gown :
Payment is by bank card (Stripe).
- Customizable gowns, diploma doors and accessories :
There is no online payment. You will be asked to do so in a separate e-mail. Subsequent changes may be made.
After placing your order, you will receive a confirmation email from us with your full order details. You do not pay until you receive your confirmation email, which also includes instructions for payment by credit card (Stripe) or swift transfer.
Article 5 - Distance purchasing: Right of withdrawal
EXERCISING THE RIGHT OF WITHDRAWAL
In the case of purchases on the Internet or by e-mail, the non-professional buyer has a 14-day cooling-off period without having to justify his decision or pay any penalty.
This period runs from receipt of the products by the buyer, or when a third party other than the carrier and designated by the buyer, takes physical possession of the goods.
The decision to retract must be communicated to the seller by e-mail sent to contact@benotshop.com. It will be sufficient for the purchaser to identify his/her order and to indicate that he/she is withdrawing from said order or to use any other wording resulting in a request for cancellation of the purchase.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to :
- the supply of services which have been fully performed before the end of the withdrawal period and where performance has begun after the consumer has given his express prior consent and expressly waived his right of withdrawal,
- the supply of goods made to the consumer's specifications or clearly personalised.
RETURN OF GOODS
Returns must be in their original condition and complete (packaging, accessories, instructions). In this case, the buyer is liable. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.
Goods must be returned to the shipping address no later than 3 days following notification of the decision to withdraw.
The cost of returning the goods shall be borne by the purchaser.
REPAYMENT OF SUMS PAID
If the right of withdrawal is exercised, the seller will reimburse the sums paid, using the same means of payment as that used for the order, provided that the goods have been returned.
Article 6- Availability
The seller's products are offered while stocks last. In the event of stock shortages or for products not in stock, offers are valid subject to availability from suppliers.
If a product is unavailable after the order has been placed, the seller will inform the buyer by e-mail. The order will be cancelled or postponed with the customer's agreement.
Article 7 - Delivery.
- Standard university gowns:
Packages are generally dispatched within 48 hours of receipt of payment and take a maximum of 2 to 3 weeks for standard delivery (subject to availability).
We will provide you with a link to track the delivery of your parcel online as soon as possible.
- Customised products:
Please note that personalised products (scarves, gowns, headdresses, etc.) require a production time of approximately 2 weeks. Delivery of these products will take place approximately 4 to 5 weeks maximum after validation of the quotation and the final proof.
The seller will do its utmost to respect the delivery time indicated. However, this delivery time is not contractual; failure to respect it may not result in a penalty for late delivery or cancellation of the order.
Product prices do not include shipping costs.
Depending on the order, orders are sent by carrier or by the Post Office (traced or untraced parcels), which are solely responsible for correct delivery.
The purchaser undertakes to sign the consignment note or delivery note presented by the carrier or the Post Office.
The seller cannot be held responsible for delivery times being exceeded or for loss or damage to a product caused by the carrier or the Post Office.
In the event of damage to the goods delivered, any reservations must be notified to the carrier or the Post Office when the product is delivered on the delivery note or within 3 days at the latest. The seller must be informed within the same period.
In the event of an unusual delay or loss, the buyer is advised to notify the carrier or the post office as soon as possible. However, the seller will endeavour to assist the buyer in his search.
Article 8 - Guarantee
All products are covered by the legal guarantee of conformity and the guarantee against hidden defects.
However, the seller cannot be held responsible for any input errors made by the customer when ordering.
In the event of non-conformity of a product sold, it may be returned, exchanged or reimbursed.
All claims, requests for exchange or refund must be made by e-mail with acknowledgement of receipt within 3 days of delivery.
Products must be returned in the condition in which they were received, with all components (accessories, packaging, instructions, etc.). Postage costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of supporting documents.
The provisions of this article do not prevent the distance buyer from benefiting from the right of withdrawal provided for in article 5.
Article 9 - Liability
The products offered comply with current French legislation. The seller may not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the buyer's responsibility to check with the local authorities regarding the possibility of importing or using the products or services he/she intends to order.
Furthermore, the seller may not be held liable for any damage resulting from improper use of the product purchased.
Finally, the seller shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses.
Article 10 - Applicable law in the event of disputes
These terms and conditions are governed by the laws of the United States. Any dispute relating to these terms and conditions shall be subject to the jurisdiction of the courts of the United States. If any part or provision of these terms and conditions is found by any court or other authority to be invalid and/or unenforceable pursuant to applicable law, that part or provision will be modified, deleted and/or enforced to the maximum extent permissible so as to effect the intent of these terms and conditions. The remaining provisions shall not be affected.
